Placing an order

 

Your order is an offer to GamingPC.ca to buy the product(s) and/or services listed in your order. When you place an order to purchase a product and/or service from GamingPC.ca, we will send you an email confirming receipt of your order and containing the details of your order along with a sales order number (the “Order Confirmation”). Your receipt of the Order Confirmation only confirms that we have received your order; it does not constitute GamingPC.ca’s acceptance of your order or GamingPC.ca’s confirmation of our offer to sell. An order is not binding upon GamingPC.ca until it is accepted; GamingPC.ca must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Once payment is received and an order is accepted, GamingPC.ca will issue an invoice to you and a contract will come into existence between you and us.

GamingPC.ca may, in its sole discretion, at any time after receiving your order, accept or decline your order for any reason. In addition, GamingPC.ca may, in its sole discretion, cancel your order and limit order quantity. Where your order is declined, cancelled or limited, we will inform you of this by appropriate means and you will not be charged if, however, your order is limited or canceled after your credit card has been charged for the purchase, GamingPC.ca will issue a credit to your credit card account in the amount of the charge.

We may process payment for and ship parts of your order separately.

You consent to receive sales invoices electronically. Electronic invoices will be made available in pdf format in the “your account” area of the Site.

 

Content on the Site, Intellectual property

 

All content included on the Site, such as text, graphics, logos, images, videos, digital downloads, data, software, any other material, and the design selection and arrangement thereof and all intellectual property rights in and to such content, design, selection and arranged are owned by or licensed to GamingPc.ca, its suppliers, licensors, or other providers of such material and are protected under Canada and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. GamingPc.ca and its suppliers and licensors expressly reserve all intellectual property rights in all content.

These Terms permit you to use the Site in accordance with these Terms for your personal, non-commercial use only.

The GamingPc.ca name, logos, service names, designs, and slogans are trademarks of GamingPc.ca. You must not use such marks without the prior written permission of GamingPc.ca. All other names, logos, product and service names, designs and slogans that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by GamingPc.ca. You must not use such marks without the prior written permission of their owner.

 

Pricing and availability

 

All prices are displayed in Canadian Dollars or “CAD”.

The price of a product is indicated on the order pages when you place an order. Please note that all pricing is subject to change without notice, and GamingPc.ca reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes and other extenuating circumstances. Please note that changes to GamingPc.ca-controlled prices, specifications and terms will be effective only after the effective date of the change and will not affect any dispute arising prior to the effective date of the change.

On rare occasions, an item in our catalogue may be mispriced. We will verify pricing when processing your order and before we take payment. IF WE HAVE MADE A MISTAKE AND A PRODUCT’S CORRECT PRICE IS HIGHER THAN THE PRICE ON THE SITE, WE MAY EITHER CONTACT YOU BEFORE SHIPPING TO ASK WHETHER YOU WANT TO BUY THE PRODUCT AT THE CORRECT PRICE OR CANCEL YOUR ORDER AND WE WILL NOTIFY YOU OF SUCH CANCELLATION. If a product’s correct price is lower than our stated price, we will charge the lower amount and send you the product.

GamingPc.ca may limit the number of products available for purchase. GamingPc.ca may, in its sole discretion, at any time, for any reason, change the quantities available for purchase. We therefore encourage you to check our Site on a regular basis for information on limitations on quantities.

We list availability information for products sold by us on the Site, including on each product information page. Beyond what we say on that page or otherwise on the Site, we cannot be more specific about availability. As we process your order, we will inform you by email as soon as possible if any products you order turns out to be unavailable. GamingPc.ca shall at its sole discretion, at any time, have the right to refuse or cancel any order for a product that is unavailable. If such order is canceled after your credit card has been charged for the purchase, GamingPc.ca will issue a credit to your credit card account in the amount of the charge.

Building Time

 

Since we offer many possible variations for each machine, GamingPC.ca assembles all systems on order.

The standard build time is around 15 to 20 business days, though mat be delayed depending on

  • stock availability
  • the number of machines to be built simultaneously
  • defective part(s) (Yes brand-new parts can be defective (DOA)) and this is why we test all our machine for a minimum of 72h.

These problems can make the build time longer. Because of that, GamingPC.ca gives a maximal delay of 30 business days before your order gets shipped.

* Shipping transit time showed in the shipping method is an estimation of the transit time from our warehouse to your place, this is transit time only and does not include the build time

 

Returns

 

All products bought at GamingPc.ca may only be returned for repair under warranty for the warranty period; the warranty information is clearly indicated on your invoice.

For products bought after August 26, 2018, the warranty is 5-year labour, 3 parts; for products bought before August 26, 2018, if the warranty period is not written on the invoice the warranty is 1-year parts and labour form the Invoice date indicated in the top right corner of your invoice.

If the defective item is no longer available, we will exchange it for the same item in a different brand or for a better model; the defective product can also be repaired by the manufacturer and returned as a refurbished item.

You need to contact us at RMA@gamingpc.ca before returning your product for repair in order to get an RMA number, all items returned without an RMA number will be returned at the customer’s expense.

The customer has to pay the shipping to return the product to GamingPc and needs to conform to our packaging standards or re-use the original boxes, any physical damage or loss during the shipping will not be covered by GamingPc.

It’s the customer’s responsibility to inform us of any changes of address before we have shipped back the repaired product, if the customer does not inform us of any changes of address, we will use the address we have on file to return the product and cannot be held responsible if the customer has changed location.

We will cover the shipping to return the repaired item using exclusively the Canada Post Expedited ground services. If the customer prefers to upgrade the service to an express delivery the customer will have to pre-pay the difference in price to upgrade the service. Products cannot be returned for a refund.

All cancelled orders are subject to a 15% restocking fee if cancelled after the order confirmation email is issued. The order cannot be cancelled if the order is shipped.
